Terms of use of STATOLOGY.com. This Agreement ("Agreement") forms a legally binding contract between you ("User") and STATOLOGY organized and existing under the laws of the State of California.  This Agreement states the terms and conditions under which you may access and use STATOLOGY.com ("Website").  The terms "you" and "User" as used herein refer to all individuals and/or entities accessing or using this Website for any reason.  

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY.  BY USING THE WEBSITE YOU AGREE TO BE LEGALLY BOUND AND TO ABIDE BY THIS AGREEMENT AS IF YOU HAD SIGNED IT.  IF YOU DO NOT WISH TO BE BOUND BY THIS AGREEMENT DO NOT USE THE WEBSITE IN ANY FASHION.  STATOLOGY MAY REVISE THESE TERMS AND CONDITIONS AT ANY TIME BY UPDATING THIS POSTING.  ANY CHANGES TO THIS POSTING ARE CONSIDERED BINDING.

Website Copyright.  STATOLOGY authorizes you to view and download a single copy of the material on the Website solely for personal, noncommercial use.  Any other use is prohibited without the express written permission of STATOLOGY.  All custom graphics, icons, logos and service names, service marks and trademarks are registered trade names, service marks, or trademarks of STATOLOGY.  All other trademarks, service marks, and graphics are the property of their owners and are used with permission.  You shall not copy or adapt the HTML code that STATOLOGY creates to generate the pages on the Website.  It is also protected by STATOLOGY's copyright.

Changes.  STATOLOGY reserves the right to update the website at any time or to discontinue the Website without prior notice or liability.  Any such change shall be effective immediately upon posting on the Website.  By continuing to access and use the Website you accept any such changes.

Charges.  Use of the Website is without monetary charge.  

General Rules of Use.  (a) This Website may only be used by persons seeking information about services offered by STATOLOGY or by clients of STATOLOGY.  The Website or any information contained on any page of the Website shall not be used for any other purpose.  Such use shall be consistent with the rights of other Users and third parties all as determined in the sole discretion of STATOLOGY.  STATOLOGY reserves the right to refuse access or use of the Website to anyone.   Without limiting the foregoing, this Website shall not be used in any manner that would violate any law or infringe any copyright, trademark, trade secret, right of publicity, right of privacy or any other right of any person or for the purpose of transmitting or storing material that is obscene or defamatory.  Every User is prohibited from posting on, or transmitting through this Website any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including without limitation, any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, otherwise violate any applicable local, state, national or international law.  (b) Specific Prohibited Uses.  No User shall use the Website to:

i.  Impersonate any person or entity, including, but not limited to, any official or employee of STATOLOGY or any other User or falsely state or otherwise misrepresent your affiliation with a person or entity; ii.  Employ any misleading e-mail addresses or falsify information in the header, footer, return path, or any part of any communication, including e-mails; or registration information; iii.  Upload, post, e-mail, or otherwise transmit or otherwise post links to any content that you do not have a right to transmit under any law or regulation or under contractual or fiduciary relationships (such as inside information, or proprietary or confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); iv.  Upload, post, e-mail or otherwise transmit or post links to any content that facilitates "hacking"; v.  Upload, post, email, otherwise transmit or post links to any unsolicited or unauthorized advertising, promotional materials, "junk mail", "spam", "chain letters", "pyramid scheme", or any other form of solicitation; vi.  Upload, post, e-mail, otherwise transmit or post links to any material that contains software viruses, worms, trojan horses, time bombs, trap doors, or any other computer code, files or programs or repetitive requests for information designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or to diminish the quality of or interfere with the performance of, or impair the functionality of the Website; vii.  Upload, post, e-mail, otherwise transmit or post links to any content that promotes any illegal activity; viii Delete or revise any material posted by any other person or entity; ix.  Upload, post, e-mail or otherwise transmit or post links to any material, or act in any manner that is offensive to these rules of use as determined in the sole discretion of STATOLOGY.  x.  Use any information on the Website to create email "spam" lists.  xi.  Attempt to violate the security of the Website, including, but not limited to, accessing data not intended for such User or logging into a server or account which the User is not authorized to access; attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization.  x.  Post any information which is incomplete, false or inaccurate or which is not a User's own accurate information.  xi.  Take any action that imposes an unreasonable or disproportionately large load on the Website's infrastructure as determined in the sole discretion of STATOLOGY.  xii.  Attempt to decipher, de-compile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Website.  (c)Investigation; Cooperation with Law Enforcement.  STATOLOGY, in its sole discretion, may investigate occurrences that may involve violations of any terms of use in this Agreement and will cooperate with law enforcement authorities in prosecuting Users who are involved in the violation of any law with respect to the use of the Website.

Termination of Use.  Any violation of any provision of this Agreement by a User shall be grounds for immediate termination of use by such User.  Whether or not there has been a breach of the Agreement or any violation of the terms of this Agreement by the User shall be made in the sole discretion of STATOLOGY and such determination shall be conclusive and binding on such User.

Disclaimers.  (a) All information and materials you find on this Website are provided "as is" without warranty of any kind, either express or implied, including without limitation any warranty for information provided through or in connection with the Website or any implied warranties of merchantability, fitness for a particular purpose, expectation of privacy or non-infringement or any warranty regarding accuracy, reliability, completeness or timeliness of the material, services, software, text graphics, and links or any other matter on the Website.  STATOLOGY makes no warranty or representation of any kind that this Website may be accessed or otherwise used or information downloaded outside the United States of America.  Access and use of the Website and/or downloading of information may be illegal by certain persons in certain countries.  If you access the Website outside the United States of America you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.  (b) User Submissions.  (i) STATOLOGY disclaims any liability or responsibility of any kind for damages or injury of any kind which may result from a User submission.  (ii).  Privacy.  Information submitted to the Website is not secure and STATOLOGY does not guarantee the security or privacy of any User information or communication.  (iii).  Investigation of Violations of Terms and Conditions.  If notified by a User of communications or other submissions that allegedly do not conform to this Agreement, STATOLOGY may investigate the allegation and determine in it sole discretion whether to remove or request the removal of the communication or submission.  STATOLOGY has no liability or responsibility to Users for performance or nonperformance of such activities.  Notwithstanding the foregoing, STATOLOGY shall remove or block communications or submissions as required by paragraph 7 of this Agreement for the sole purpose of complying with the copyright infringement safe harbor provided by title 17 United States Code §512.  (c).  Links.  Certain links on this Website lead to resources located on servers that are not maintained by STATOLOGY or are not under its control.   STATOLOGY is not responsible for the contents of any such referenced Websites or for the availability or access to such Websites.  (d) Assumption of Risk.  In addition to assumption of risk or waiver of liability provisions elsewhere in this Agreement, a User assumes all risks of every kind associated with using the Website.  

Copyright Infringement; Notice Agent.  STATOLOGY will terminate the account of any User, and block access to the Website of any Users who are repeat infringers of the copyrights, or other intellectual property rights of others.  STATOLOGY reserves the right to take these actions at any time; its sole discretion, with or without notice, and without liability to the User who is terminated or to the User whose access is blocked.  (a) Notice to STATOLOGY.  If you believe that your work appears on this Website in a way that constitutes copyright infringement you agree to notify us in writing.  i.  A physical or electronic signature indicating that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.  ii.   Identification of the copyrighted work claimed to have been infringed or, if multiple copyrighted works are covered by a single notification, a representative list of such works.  iii.  Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit STATOLOGY to locate the material.  iv.  A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.  v.  A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.  (b) Access to Infringing Material.  Upon notification of claimed infringement, STATOLOGY will expeditiously remove or disable access to, the material that is claimed to be infringing or to be the subject of infringing activity or may restore access to such material all in conformity with Title 17 United States Code §512(g).

Entire Agreement.  This Agreement contains the complete agreement of the Parties regarding the subject matter herein and supersedes any prior understanding or verbal or oral agreement on any matter that is the subject of this Agreement.
